1.			Call to Order.

2.			Invocation and Pledges of Allegiance by Commissioner Ken DeMerchant.

3.			Approve minutes of regular meeting held on February 9, 2021.

4.			Public Comments regarding the Agenda and Announcements.

5.			PUBLIC HEARINGS: 1:00 p.m.:

	A.		Conduct public hearing on the creation of Fort Bend County Reinvestment Zone No. 28, proposed to be located west of the City of Rosenberg, on the north side of the BNSF railroad and SH 36 (also known as 36th Division Memorial Highway), just east of Spur 10 located in Precinct 1.

	B.		Conduct public hearing on the Guidelines and Criteria for Granting Tax Abatement Agreements in Fort Bend County, pursuant to Section 312.002(c-1) of the Texas Tax Code.

	C.		Engineering: Conduct Public Hearings and take all appropriate action on the following matters:

		1.	Acceptance of the traffic control plan for Chimney Rock Road, Mobility Bond Project No. (2007) x20, from Cambridge Falls Drive to Acorn Glen Trail, Precinct 2.

		2.	Acceptance of the traffic control plan for Stratford Creek Drive in Stratford Park Village Section 3, Precinct 4.

		3.	Acceptance of the traffic control plan for Grand at Aliana, Precinct 4.

CONSENT AGENDA ITEMS 6 -17:

6.			COUNTY JUDGE:

	A.		Accept and record the generous donation by Deepthi Raju in the amount of $ 300 to be used for the Adopt-A-Family Fort Bend Program.

	B.		Approve request for Historic Site Property Tax Exemption from the General Fund for the Teague-Waddell House, located at 1810 Avenue M in Rosenberg, Texas, for tax year 2021.

7.			COMMISSIONER, PCT. 1:

			Approve Interlocal Project Agreement between Fort Bend County and the City of Rosenberg to provide assistance by overlaying with Type D Asphalt city-owned streets as detailed within the Agreement; County expenditure not to exceed $73,200. (Fund: Road & Bridge)

8.			COMMISSIONER, PCT. 3:

	A.		Appoint Debra Cates to the Fort Bend County Library Advisory Board effective February 23, 2021 through December 31, 2022.

	B.		Approve Interlocal Agreement for Contribution to Construction of Fry Road Esplanade Improvements between Fort Bend County and Cinco Municipal Utility District No. 5.

9.			BUDGET TRANSFERS:

	A.		400th District Court: Approve transfer in the amount of $17 from Supplies and Maintenance into Information Technology to allocate additional funds for computer related equipment.

	B.		Elections Administration: Approve transfer in the amount of $600 from Fees into Information Technology to allocate funds into correct account for the purchase of flash drives.

	C.		Fire Marshal: Approve transfer in the amount of $40,000 from Salaries into Overtime to allocate funds for shortage in overtime account.

10.			ENGINEERING-PAYMENTS:

	A.		Approve payment of Invoice No. 1 in the amount of $6,732 to Gonzalez Construction Enterprise Inc. for reconstruction of Bryan Road, Mobility Project No. 17118 Precinct 1. (Fund: Mobility Bonds)

	B.		Approve payment of Invoice No. 202100278 in the amount of $1,410.88 to Berg-Oliver Associates, Inc. for professional environmental services regarding Lake Olympia, Segment 2, Mobility Bond Project No. 13217x, Precincts 1 and 2. (Fund: Mobility Bonds)

	C.		Approve payment of Invoice No. 17CM01-22 in the amount of $31,069 to Isani Consultants, L.P. for professional construction management services regarding Mobility Projects, Precinct 1,2,3, and 4. (Fund: Mobility Bonds)

	D.		Approve payment of Invoice No. FBC1907-15 in the amount of $38,230 to AIG Technical Services, LLC for professional engineering services regarding Mobility Projects within Precincts 1, 2, 3, and 4. (Funding: Mobility Bonds)

	E.		Approve payment of Invoice No. 7696 in the amount of $30,688.75 to Property Acquisition Services, LLC for right of way services regarding 2017 Mobility Bond Projects within Precincts 1 and 4. (Fund: Right of Way)

	F.		Approve payment of Invoice No. 226-02-14 in the amount of $11,195.94 to EJES Inc. for professional engineering services regarding Belknap Road Mobility Bond Project No. 17211 Precincts 2 and 3. (Fund: Mobility Bonds)

	G.		Approve payment of Invoice No. 1 in the amount of $42,808.50 to 717 Construction Services LLC for construction of Westheimer Parkway Turn Lane, Mobility Project No. 17319x, Precinct 3. (Funding: Mobility Bonds)

	H.		Approve payment of Invoice No. 244760 in the amount of $9,630.75 and Invoice No. 245548 in the amount of $10,412 to Ninyo & Moore for construction material testing regarding Cane Island, Segment 2, Mobility Project No. 17308, Precinct 3. (Fund: Mobility Bonds)

11.			FACILITIES MANAGEMENT & PLANNING: The Director of Facilities Management & Planning submits these invoices for approval and payment for projects that are funded by 2015 Facility Bonds and by 2020 Certificates of Obligation:

	A.		Invoice No. 220011 in the amount of $76,029 to Brazos-Valley Division for roof replacement at the Fifth Street Community Center;

	B.		Pay Application No. 1 in the amount of $198,512 and Pay Application No. 1 in the amount of $284,297 to CS Advantage, Inc. for roof replacement at the Missouri City Branch Library and Cinco Ranch Branch Library respectively;

	C.		Pay Application No. 3 in the amount of $8,400.18 to Nash Industries for renovations regarding the Jail Shower Renovation;

	D.		Pay Application No. 4 in the amount of $242,664.02 to Crain Group for construction services regarding the Precinct 3 Public Safety Annex;

	E.		Invoice No. 12409 in the amount of $7,140 to Airborne Athletics for furniture, fixture, and equipment items regarding the Landmark Community Center;

	F.		Invoice No. 2820 in the amount of $6,465 to Ace Piano Clinic for furniture, fixture, and equipment regarding the Landmark Community Center;

	G.		Invoice No. 10052633 in the amount of $23,704.71 to PGAL for design services regarding the Emergency Operations Center;

	H.		Invoice No. S-52671 in the amount of $3,550 to Howell Services for sewer line services regarding the Emergency Operations Center.

12.			HEALTH & HUMAN SERVICES:

	A.		Animal Services: Accept Report of donations received for Animal Services operations for the period of October through December 2021.

	B.		Social Services: Accept grant funds in the amount of $227,817 awarded by the National Emergency Food and Shelter Program (EFSP) Phase 38, administered via the Alliance of Community Assistance Ministries (ACAM) for the use in the following categories: Food: $32,625; Utilities $139,265; Rent/ Mortgage $139,265, with no cash match required by Fort Bend County.

13.			HUMAN RESOURCES:

			Approve request for withdrawal of 320 hours from the Shared Sick Leave Pool for employee of Road & Bridge, Position No. 6111-0127.

14.			PUBLIC TRANSPORTATION:

			Approve payment of Invoice No. 10456824240 in the amount of $7,056 to Dell Marketing L.P. for laptops and desktop computer regarding the Transit Center Mobility Bond Project No. 13406. (Fund: 2013 Mobility Bonds)

15.			PURCHASING:

	A.		Authorize renewal of Bid 20-040, term contract for pavement painting, marking supplies and services on various roads with Lone Star Pavement Services.

	B.		Authorize renewal of Bid 20-043, term contract for thermoplastic traffic coating with Stripes & Stops Company, Inc.

	C.		Authorize renewal of Bid 20-077, term contract for rental vehicles and services with Enterprises Holdings, Inc. dba Enterprise Rent-A-Car.

	D.		Authorize renewal of Bid 20-017, term contract for on-site clearing, grubbing, demolition and debris removal services for various Fort Bend County road projects with TFR Enterprises, Inc. as primary and D&M Excavating, LLC as secondary.

16.			ROAD & BRIDGE:

			Approve payment of Invoice No. 21-0116 in the amount of $159,580 to Helfman Dodge for four 2021 vehicles. (Fund: 2020 Certificates of Obligation)


17.		SHERIFF'S OFFICE:

	A.	Record into Minutes the Agreement between Fort Bend County Sheriff and Jail Chaplaincy Ministries, Inc. for Jail Chaplaincy Services. (Fund: Sheriff's Office Commissary)

	B.	Record into Minutes the 2020 Racial Profiling Report for the Sheriff's Office, pursuant to Code of Criminal Procedure Articles 2.121-2.138.



18.		COUNTY JUDGE:

	A.	Discuss and take any appropriate action regarding the Declaration of Local Disaster related to Severe Winter Weather ordered by County Judge on February 17, 2021.

	B.	Take all appropriate action on Order Creating Fort Bend County Reinvestment Zone No. 28.

	C.	Discuss and consider approving an advanced funding resolution to facilitate the purchase of appropriately 51.75 acres of land to be used for the development of the Fort Bend EpiCenter project and authorize the Auditor, County Attorney and County Judge to take all necessary actions to purchase the property.

	D.	Take all appropriate action on the pursuit of a Ground Lease / Lease Back Development Agreement for the development of an approximately 230,000 square foot multipurpose facility to be known as the “Fort Bend Epicenter” subject to County Attorney approval as to form and authorize the County Judge to execute the agreement.

19.		AUDITOR:

		Take all appropriate action on request to authorize County Auditor to reimburse County Clerk employees without requiring a purchase order for individual criminal background checks required by the Texas Department of State Health Services Policy No. AA-6001 to access TXEver. (Fund: Vitals Preservation Fund)


20.		COUNTY ATTORNEY:

		Take all appropriate action on request to reclassify vacant Position No. 4751-0013, in the Office of County Attorney from Civil Attorney-Litigation, Grade 15 of the Professional Management Policy Group to Chief - Regulatory, Grade 17 of the Professional Management Policy Group, effective February 23, 2021. (Fund: County Attorney)

21.		COURTS ADMINISTRATION:

	A.	Take all appropriate action on request to create one part-time position to coordinate the Expedited Narcotics Docket (END) Program.

	B.	Take all appropriate action on request to transfer the amount of $40,704 from Non-Departmental Contingency as detailed on Judge William's form dated February 8, 2021 to allocate funds for part time position to coordinate the END program.

22.		ENGINEERING:

	A.	Take all appropriate action on Possession and Use Agreement between Fort Bend County and Brian Keith Thomas regarding Parcel 4 of South Post Oak Mobility Bond Project No. 13112, Precinct 1, and record same in official public records.

	B.	Take all appropriate action on request to purchase Parcel 1 in the amount of $25,335.33 plus necessary costs, and authorize the County Judge to sign all closing documents regarding said Parcel for Packer Lane Lift Station No. 3, Mobility Bond Project No. 13219x, Precinct 2; authorize County Clerk to record in Official Public Records at no cost. (Fund: Mobility Bonds)

23.		HOMELAND SECURITY & EMERGENCY MANAGEMENT:

		Take all appropriate action on the revised Application for Federal Assistance for an increase of grants funds in the amount of $165,000 for the 2016 Hazard Mitigation Buyout Grant. (FEMA Project Number DR 4269-007)

24.		PARKS & RECREATION:

		Take all appropriate action on request by Texas Wildlife Rehabilitation Coalition to release certain wildlife excluding squirrels at county parks within Precincts 2, 3, and 4.

25.		PUBLIC TRANSPORTATION:

	A.	Take all appropriate action on the Texas Department of Transportation Federal Mask Mandate Acknowledgment as it relates to the Presidential Executive Order 13998 published on January 26, 2021.

	B.	Take all appropriate action on request to ratify Application to Texas Department of Transportation for Fiscal Year 2021 CARES Act Rural Federal funds in the amount of $930,237 for assistance with transportation programs, including grantor’s request for submittal of additional information, with no local match required by Fort Bend County.

26.		PURCHASING:

	A.	Take all appropriate action on RFP 21-051 for Hazmat Response Vehicle for the Fort Bend County Fire Marshal’s Office.

	B.	Take all appropriate action on Bid 21-040 Construction of Ransom Road widening from West of Hudson Oaks Lane to Fort Bend County Municipal Utility District No. 121 Levee. (Fund: Mobility Bonds)

	C.	Take all appropriate action on Twelfth Addendum to Software and Maintenance Agreement between Fort Bend County and Trapeze Software Group, Inc. pursuant to RFP 06-101 in an amount not to exceed $29,630 for Scheduling Software for Public Transportation, effective March 1, 2021 through February 28, 2022. (Fund: Public Transportation, Grants)

	D.	Take all appropriate action on Addendum to Agreement between Fort Bend County and Hunton Services utilizing Choice Partners Purchasing Cooperative Contract Number 19/036-MR-03 for mechanical service and scheduled maintenance in an amount not to exceed $77.882.76. (Fund: Facilities, Operations)

27.		Approve Bills.


28.		WORKSHOP:

	A.	Workshop to receive presentation by Fort Bend County Emergency Medical Service Chief Graig Temple regarding emergency service operations.

	B.	Discuss and consider approving an advanced funding resolution to facilitate the purchase of necessary expenditures related to Emergency Medical Service vehicles for an amount not to exceed $420,000.

29.		Meet in Closed Session to deliberate the following matters as authorized by the Texas Government Code:

		§ 551.071. Consultation With Attorney. Commissioners Court will meet in Closed Session to seek the advice of its attorney about pending or contemplated litigation; a settlement offer; or on a matter in which the duty of the attorney to Commissioners Court under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Texas Government Code Chapter 551.

		Threatened litigation regarding payroll-related dispute.

30.		Reconvene Open Session and consider taking action on the following matters:
